Dispute over fitting of high-end bespoke flooring in a large property in Warwickshire. Client had been refurbishing a very large property and sourced flooring, spending over £20k on supply and fit. When the flooring was fitted there were some ‘short-cuts’ with a minimal value and our client held back paying some of the bill as a result. Our client was then sued in the small claims court. However, it became more and more apparent that the flooring was starting to fail. The matter soon became a full multi-track construction-based dispute with a £50,000 + counterclaim (remedial costs). Expert reports were produced (via the market leading expert in flooring) which indicated a fitting process had taken place without reasonable care and skill having been used and in non-compliance with the manufacturer’s installation recommendations/guidance. Counsel became heavily involved and the matter was listed for a 2 day trial. This was adjourned as further expert evidence was needed. Eventually the matter was settled heavily in our client’s favour on the morning of the adjourned trial.
